Just Resolutions

Rich Cassidy works as a professional mediator and arbitrator.  He believes in helping the parties to disputes reach "Just Resolutions." When the parties to a dispute are able to resolve a dispute, by agreement, there is a certain justice that may be lacking when a third-party, such as a judge or judge and jury imposes a result.
Some cases cannot be resolved except by an imposed solution. But the parties should first try to reach a negotiated settlement. Such a resolution is always quicker and faster than going to trial, and creative results may be possible that no court could reach.

Verdicts And Settlements

Richard Cassidy has obtained many millions of dollars of settlements and verdicts for his clients.

In Brueckner v. Norwich University, 169 Vt. 118; 730 A.2d 1086 (1999), Cassidy won a 2.3 million dollar verdict in hazing case against Norwich, a private military college. The punitive damage portion of the verdict, was reversed by a split decision on appeal, but the award of compensatory damages was upheld. The case established the important legal proposition that a University may be responsible for acts of hazing committed by student leaders authorized to orient and indoctrinate first-year students. W. Kaplin and B. Lee, The Law of Higher Education, at 312. (4th Edition, Jossey-Bass (2007)).

Other notable results include the recovery of many hundreds of thousands of dollars in a number of employment discrimination cases, a $700,000 settlement in a slip and fall case, a $620,000 settlement in a wrongful death claim based on a falling tree and, a $3.6 million dollar settlement in a combined employment/commercial dispute and, a $1.3 million dollar settlement in phase one of a serious personal injury case and most recently, a $47,500 settlement in a ski liability case.
